MISTAKEN SEIZURE OF MR AND MRS WALKER'S CAR BY THE HIGH SHERIFF OF ESSEX

EDM number 216 in 1992-93, proposed by Michael Clark on 09/06/1992.

That this House regrets that the High Sheriff of Essex, in attempting to enforce a writ issued by the Southend Court for recovery of debt, seized a motor car parked in the driveway of the debtor's house, and despite enquiries to the DVLC showing that the debtor was not the keeper of the vehicle, eventually sold the vehicle at auction; deplores the fact that only cursory attempts were made by the Under Sheriff to locate the real owner of the vehicle who, due to not being able to afford tax and insurance had arranged long-term parking at the debtor's house; is greatly surprised that the High Sheriff will not recognise his mistake nor offer compensation; and calls on the High Sheriff of Essex to withdraw his threat to defend vigorously the mistaken action he and his staff have taken and make full and proper restitution to Mr and Mrs Walker.
