Sheriff Court Fees

EDM number 379 in 1993-94, proposed by John McFall on 19/01/1994.

That this House calls for the withdrawal of the Sheriff Court Fees Amendment (No. 2) Order; is mindful of the case of a constituent of the honourable Member for Dumbarton who was subjected to domestic violence at the beginning of January 1994 and who was obliged to pay ú123 to the court in order to have her husband excluded from the matrimonial home; notes that before 1st January she would have paid ú40 for the same procedure; notes that ú123 represents over 80 per cent. of her weekly salary; and is of the opinion that the consequence of the Sheriff Court Amendment (No. 2) Order is to restrict access to justice to individuals on low incomes.
