Powers Of National Rivers Authority

That this House notes the ruling in the House of Lords on 17th November last year in the case of The National Rivers Authority v. Yorkshire Water Services; notes that the effect of the Court's ruling is that a person to whom the NRA has granted a consent, pursuant to Act of Parliament, to discharge specified amounts of a specified substance into a river or watercourse, may in some circumstances be legally entitled to discharge unlimited amounts of other substances not mentioned in the consent; accepts the concern of the NRA that this effectively turns a discharge consent into a licence to pollute; regrets that the Government did not accept an amendment to the Environment Bill [Lords] on behalf of the NRA, which would rectify this situation; and hopes that the Government will accept an amendment to the Bill in this House.
