That this House notes that Anthony Clayton made an application to the European Court of Human Rights in 2010 (Application: 31251/10); further notes that this application was based on the failure of his legal advisers to enter evidence into court in case HB30448 Smith v Clayton; further notes that it was declared inadmissible by the European Court of Human Rights sitting as a single judge; further notes that no reasons are given bythe European Court of Human Rights; further notes that this difficulty is one that faces many applicants to the European Court of Human Rights; and calls for the Government in its negotiations with the Council of Europe to argue for reasons to be given as to why the court determines that cases are inadmissible.
